1. Agreement to Terms

By accessing our website or engaging TopFlight Mechanical Services ("TopFlight," "we," "us," or "our") for industrial mechanical services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Provided

TopFlight provides specialized industrial mechanical solutions, including but not limited to leak sealing, field machining, valve maintenance, and bolting services. All services are subject to a formal quote or contract. Emergency dispatch times are estimates and may vary based on conditions, location, and technician availability.

3. Client Responsibilities & Site Safety

To ensure a safe and efficient work environment, the client agrees to:

• Provide safe and clear access to the work site and specific equipment requiring service.
• Ensure the site complies with OSHA and other relevant safety regulations.
• Communicate any known site hazards, chemical exposures, or specific safety protocols to our technicians prior to the commencement of work.

4. Quotes, Billing, and Payment

Estimates and quotes provided are valid for 30 days unless otherwise stated. Final invoicing may adjust based on unforeseen site conditions or additional requested work. Unless otherwise specified in a formal contract, payment terms are Net 30 days from the invoice date. Late payments may accrue interest at the maximum rate permitted by Texas law.

5. Warranty and Limitation of Liability

TopFlight warrants that all services will be performed in a professional, workmanlike manner in accordance with industry standards. However:

• We do not warrant against failures caused by existing equipment degradation, improper operation by client staff, or pre-existing structural flaws.
• In no event shall TopFlight be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits or facility downtime, arising out of the performance of our services.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Texas.
